1. Acceptance of Terms

By accessing and using the Yachts in Cabo website and services, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Description

Yachts in Cabo provides yacht charter and boat rental services in Cabo San Lucas, Baja California Sur, Mexico. Our services include:

• Private yacht charters for various durations
• Experienced captain and crew
• Optional meal plans and catering
• Transportation services (upon request)
• Special event packages

3. Booking and Reservations

All bookings are subject to availability and confirmation. By making a reservation, you agree to the following:

• You must be at least 18 years old to make a booking
• All information provided must be accurate and complete
• A deposit is required to confirm your reservation
• Full payment must be received before the charter date
• Booking confirmation will be sent via email

4. Payment Terms

We accept payments through our secure payment processor (Stripe). Payment terms include:

• Prices are quoted in USD and MXN
• A 30% deposit is required to confirm the booking
• The remaining balance is due before the charter
• All payments are processed securely
• Prices include applicable taxes (16% IVA)

5. Cancellation Policy

Our cancellation policy is as follows:

• Cancellations made 72+ hours before: Full refund minus processing fees
• Cancellations made 48-72 hours before: 50% refund
• Cancellations made less than 48 hours before: No refund
• No-shows: No refund
• Weather-related cancellations: Full refund or rescheduling option

We reserve the right to cancel or reschedule charters due to unsafe weather conditions. In such cases, a full refund or rescheduling will be offered.

6. Guest Responsibilities

As a guest, you agree to:

• Follow all safety instructions from the captain and crew
• Not exceed the maximum passenger capacity of the vessel
• Not bring illegal substances aboard
• Be responsible for your personal belongings
• Report any damage or incidents immediately
• Treat the vessel and equipment with respect

7. Liability and Insurance

All our vessels are properly insured and maintained. However:

• We are not liable for personal injuries caused by guest negligence
• We are not responsible for lost or stolen personal items
• Guests participate in water activities at their own risk
• We recommend guests have their own travel insurance

8. Weather and Safety

Safety is our top priority. The captain has final authority regarding:

• Whether conditions are safe for departure
• Route modifications due to weather
• Early return if conditions deteriorate
• All safety-related decisions during the charter

9. Alcohol and Conduct

While moderate alcohol consumption is permitted on most charters:

• Excessive intoxication is not permitted
• The captain may refuse service to intoxicated guests
• No illegal drugs or substances are allowed
• Disruptive behavior may result in early return without refund

10. Intellectual Property

All content on this website, including text, images, logos, and design elements, is the property of Yachts in Cabo and is protected by copyright laws. You may not reproduce, distribute, or use any content without our written permission.

11. Governing Law

These Terms and Conditions are governed by the laws of Mexico. Any disputes arising from these terms shall be resolved in the courts of Baja California Sur, Mexico.

12. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on this website. Continued use of our services constitutes acceptance of the modified terms.
